COUNTY OF DECATUR
Under and by virtue of the Power of Sale contained in a Security Deed given by Janet L. Brock to Donald Barber (the Secured Creditor), dated September 1, 2023, and recorded on September 14, 2023, as Book No. 519 and Page No. 516, Decatur County, Georgia records, conveying the after-described property to secure a Note of even date in the original principal amount of $465,
000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the Decatur County, Courthouse within the legal hours of sale on the first Tuesday in May, 2026, the following described property:
All that real estate situated and being in the City of Bainbridge, Decatur County, Georgia, known and described as Lot No. 67 in Block “K” of the Second Addition to Morningside Subdivision of Bainbridge, Georgia, a plat of said Second Addition being recorded in the Deed Records of Decatur County, Georgia, in Plat Book 2 at Page 88, said lot being more fully described as starting at a point eighty-four (84) feet North of the Northwest intersection of College Street and Collier Street in the City of Bainbridge, thence running North along the West side of Collier Street eighty-four (84) feet to Lot No. 68, thence West a distance of one hundred thirty-five and 6/10 (
135.6) feet to a ten-foot alley, thence South along the East side of said alley a distance of eighty-four (84) feet, thence West one-hundred thirty-five and 6/10 (
135.60) feet to the Point of Beginning.
The above-described property is the identical property described in a deed from Philip N. Brownstein as Federal Housing Commissioner to Thomas B. Starling and Regina Starling dated May 13, 1965, and recorded in Deed Book H-8, Page 251, Land Records of Decatur County, Georgia.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given). Donald Barber holds the duly endorsed Note and has the full authority to negotiate, amend, and modify all terms of the loan. Pursuant to O.C.G.A. §

Please note that pursuant to O.C.G.A. §
44-14-162.2, the secured creditor is not required to amend or modify the terms of the loan.
To the best knowledge and belief of the undersigned, the party/parties in possession of the subject property known as 806 Collier Street, Bainbridge, GA 39819, is/are: Janet L. Brock or tenant/tenants. Said property will be sold subject to (a) any outstanding ad valorem taxes (included taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Security Deed first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easement, restrictions, covenants, etc.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the state of the loan with the holder of the security deed.
Pursuant to O.C.G.A. §
9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the state of the loan as provided in the preceding paragraph.
Funds used at sale shall be in certified funds and payable to “Law Office of Eric L. Gay, LLC”.
