NOTICE OF SALE
GEORGIA, DECATUR COUNTY
WHEREAS, on May 9, 2025, Level Place, LLC delivered to R. Bruce Warren Family Limited Partnership a certain security deed containing power of sale in order to secure the indebtedness therein recited, recorded May 21, 2025 in Deed Book 546, Page 465, of the Public Records of Decatur County, Georgia, conveying the following described property, to-wit:
All that tract or parcel of land situate, lying and being in Decatur County, Georgia, consisting of
69.18 acres in Land Lot 222, of the 16th Land District of Decatur County, Georgia more particularly described as follows:
Commence at an iron spike located
3.14 feet west of concrete marker located at the intersection of the West right-of-way line of Pelham Road and the line separating Land Lot 222 and Land Lot 259 of the 16th Land District of Decatur County, Georgia, thence South 89 degrees 45 minutes 20 seconds East along the land lot line separating Land Lots 222 and 259
1286.12 feet to an iron pin and the POINT OF BEGINNING;
Thence South 89 degrees 43 minutes 39 seconds East
1936.28 feet to a point at the Northeast corner of Land Lot 222; thence South 02 degrees 05 minutes 57 seconds West
1612.05 feet along the East Land Lot line of Land Lot 222 to an iron pin; thence South 89 degrees 13 minutes 48 seconds West
1809.20 feet to an iron pin; thence North 00 degrees 06 minutes 22 seconds East
1323.59 feet to an iron; thence North 87 degrees 19 minutes 21 seconds West
79.06 feet to an iron pin; thence North 1 degree 30 minutes 28 seconds East
317.37 feet to an iron pin and the point of beginning. Said parcel contains
69.18 acres according to that plat of survey recorded in Plat Cabinet C83, Page 2 in Land Lot 222 of the 16th Land District of Decatur County, Georgia.
Also conveyed is an easement for Pelham Road to the above-described parcel more particularly described as follows:
Begin at an iron spike located
3.14 feet west of concrete marker located at the intersection of the West right-of-way line of Pelham Road and the line separating Land Lot 222 and Land Lot 259 of the 16th Land District of Decatur County, Georgia; thence North 89 degrees 45 minutes 20 seconds West
1286.12 feet to an iron pin located at the Northwest corner of the subject property; thence South 60 feet along the property line of the subject property to a point; thence North 89 degrees 45 minutes 20 seconds West to East right-of-way of Pelham Road; thence North 60 along the right-of-way of Pelham Road to the Point of Beginning.
LESS AND EXCEPT:
All that tract or parcel of land situate, lying and being in Decatur County, Georgia, consisting of
29.6 acres, more or less, more particularly described on a plat of survey prepared by Holman Land Surveying Incorporated, GA license # LS003482, for Spencer Bell, dated 01/14/2024, recorded 08/26/2024 in Plat Book C126, Page 00150, among the Deed Records of Decatur County, Georgia.
WHEREAS default has been made in the payment of the indebtedness secured by the above-described security deed and the holder has elected to declare the entire amount of the indebtedness due according to the terms of the security deed and the Promissory note secured thereby. The undersigned gave Level Place, LLC, notice of default and the right to cure notice as provided in the security deed, and the default was not cured as required, and the undersigned has elected to proceed with non-judicial foreclosure as provided for in the security deed.
NOW THEREFORE, the undersigned will proceed to sell the property as the property of Level Place, LLC, at public outcry to the highest bidder for cash before the courthouse door in DECATUR county within the legal hours of sale on the FIRST TUESDAY in March, for the purpose of satisfying the indebtedness and the expenses of sale, including attorney’s fees, notice of which has been given as provided by law, and will execute a deed to the purchaser at sale in a reasonable amount of time and apply the proceeds thereof as provided in said security deed.
Said property will be sold subject to all unpaid taxes, liens, and other assessments and restrictions of record, if any. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
The undersigned reserves the right to reject any and all bids, to continue the sale from day to day and to withdraw said property from sale and subsequently to reoffer same in the event no reasonable bid is received and accepted. Pursuant to O.C. G. A.
44-14-162.2, the name, address, and telephone number of the individual or entity who shall have the full authority to negotiate, amend or modify all terms of the above-described mortgage is as follows: R. Bruce Warren Family Limited Partnership, 809 South Broad Street, Thomasville, GA 31792 (229) 226-2161. The foregoing notwithstanding, nothing in O.C.G.A.
44-14-162.2 shall be construed to require R. Bruce Warren Family Limited Partnership to negotiate, amend or modify the terms of the Deed to Secure Debt described herein.
