NOTICE OF SALE UNDER POWER
GEORGIA, DECATUR COUNTY
WHEREAS, FRANKLIN WAYNE HOLCOMBE (hereinafter “Borrower”) did execute to FIRST NATIONAL BANK OF DECATUR COUNTY (hereinafter “Lender”), certain Deed to Secure Debt (as described below) to the following lands located in Decatur County, Georgia, to-wit:
Tract I:
All that tract or parcel of land lying and being in Land Lot 2 of the 21st District of Decatur County, Georgia, containing approximately
0.769 of an acre, and being more particularly described as follows: Commence at the point of intersection of the southern right of way line of State Route Number 253 with the western right of way line of a county dirt road and run south 00 degrees 30 minutes east along the western right of way line of the dirt road 1,087 feet to the point of beginning of the herein described tract; from the point of beginning continue south 00 degrees 30 minutes East along the western right of way line of the road
100.0 feet to a point; run thence south 89 degrees 30 minutes west
290.0 feet to a point; run thence north 00 degrees 30 minutes west
150.0 feet to a point; run thence north 89 degrees 30 minutes east
90.0 feet to a point; run thence south 00 degrees 30 minutes east 50 feet to a point; and run thence north 89 degrees 30 minutes east 200 feet to the point of beginning on the western right of line of the dirt road. Reference is made to a plat of survey on which the described tract is shown.
LESS AND EXCEPT a portion in the northeastern section of the surveyed tract, fronting 50 feet on the roadway and running back westerly an even width for the distance of 200 feet, which plat is entitled “Survey for Carey Heard”, and a copy of the plat is recorded in Plat Cabinet B, Slide 2 (formerly Plat Cabinet C, Slide 192), in the Office of the Clerk of the Superior Court of Decatur County, Georgia
AND LESS AND EXCEPT that property conveyed for road right of way purposes to Decatur County, Georgia by instrument recorded in Deed Book C-15, Page 635, in the Office of the Clerk of the Superior Court of Decatur County, Georgia.

All that tract or parcel of land lying and being in Land Lot 2 of the 21st Land District of Decatur County, Georgia, containing approximately
0.230 of an acre, and being more particularly described as follows: Commence at the point of intersection of the southern right of way line of State Route Number 253 with the western right of way line of a county dirt road and run south 00 degrees 30 minutes east along the western right of way line of the dirt road 1,037 feet to the point of beginning of the herein described tract; from the point of beginning continue south 00 degrees 30 minutes east along the western right of way line of the road
50.0 feet to a point; run thence south 89 degrees 30 minutes west
200.0 feet to a point; run thence north 00 degrees 30 minutes west
50.0 feet to a point; and run thence north 89 degrees 30 minutes east 200 feet to the point of beginning on the western right of way line of the dirt road. Reference is made to a plat of survey of which the described tract is a portion in the northeastern section of the surveyed tract, fronting 50 feet on the roadway and running back westerly an even width for the distance of 200 feet, which plat is entitled “Survey for Carey Heard”, and a copy of the plat is recorded in Plat Cabinet B, Slide 2 (formerly Plat Cabinet C, Slide 192), in the Office of the Clerk of the Superior Court of Decatur County, Georgia.
LESS AND EXCEPT that property conveyed for road right of way purposes to Decatur County, Georgia by instrument recorded in Deed Book C-15, Page 635, in the Office of the Clerk of the Superior Court of Decatur County, Georgia.
The aforesaid lands are referred to herein as the “Property”.
To secure the following indebtedness: (a) that that certain Consumer Note dated October 22, 2021 in the original principal amount of $26,
546.37; (b) all renewals and extensions of the aforesaid promissory note; and (c) all additional loans and advances that might subsequently be made to Borrower by Lender, and all other indebtedness of Borrower to Lender, all as is more particularly shown by that certain Deed to Secure Debt from Franklin Wayne Holcombe to First National Bank of Decatur County dated October 22, 2021 and recorded November 1, 2021 in Deed Book 487, Pages 111 - 121 in the Office of the Clerk of the Superior Court of Decatur County, Georgia (The “Security Deed”).
Whereas, the aforesaid Security Deed and the indebtedness secured thereby is owned and held by First National Bank of Decatur County.
Whereas, Borrower defaulted by failing to pay the indebtedness secured by the Security Deed and in accordance with the provisions of aforesaid promissory note and said Security Deed, Lender has exercised its option to declare the remainder of said indebtednesses immediately due and collectible.
Now, therefore, according to the terms of the aforesaid Security Deed and the law in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the lands described in the said Security Deed, after proper advertisement, on the first Tuesday in April 2026 (April 7, 2026) between the legal hours of sale before the Courthouse door in BAINBRIDGE, DECATUR COUNTY, GEORGIA.
The proceeds from said sale will be used first for the payment of the total indebtedness now owed Lender, including principal, interest, attorney’s fees and expenses, and the balance, if any, will be delivered to the persons legally entitled thereto.

44-14-162.2 the name of the person or entity who has the full authority to negotiate, amend, or modify the terms of the aforementioned indebtedness is:

Please take notice that the Lender is not required to negotiate, amend, or modify the terms of the aforesaid promissory note and the Security Deed.
Notice of the initiation of proceedings to exercise the power of sale contained in the aforesaid Security Deed has been provided to Borrower in accordance with O.C.G.A. Section
44-14-162.2.
Said Property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the Property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the aforesaid Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the Property is Borrower (the grantor of the Security Deed), or a tenant or tenants claiming under thereunder. The street address of said Property is 142 Hales Landing Road, Bainbridge, Decatur County, Georgia 39817 and 144 Hales Landing Road, Bainbridge, Decatur County, Georgia 39817 identified as Decatur County Tax Map Parcel No. 00310010.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of said Deeds to Secure Debt.
