COMPLAINT AND LIS PENDENS NOTICE
You are hereby notified that the dwelling, building, or structure located at 1209 Third Street, Decatur County Tax Parcel B0170006, Bainbridge, Georgia 39817 (the “Property”), has been inspected and found to be an unsafe structure and unfit for human habitation or commercial, industrial, or business use as defined by the City of Bainbridge Municipal Code, including without limitation, Chapter 50-Nuisances. The conditions that make the dwelling, building, or structure unsafe and unfit for human habitation include but are not limited to the following: Fire damage including the roof caving in, floor and walls damaged by fire, electrical and plumbing systems damaged beyond repair and must be replaced, broken windows, and rotting siding. The building is dilapidated and structurally unsound.
The Property referred to above is described with particularity on Exhibit “A” attached hereto.
SUMMONS & NOTICE
A hearing will be held before me on April 7, 2026 at 9:00 A.M. at City Hall, 101 S. Broad Street, Bainbridge, GA 39817. If at the hearing it is determined the repair, alteration, or improvement of the said dwelling, building, or structure can be made at a reasonable cost in relation to the present value of the dwelling, building, or structure, the owner will be required, within a certain amount of time, to repair, alter, or improve such dwelling, building, or structure so as to bring it into full compliance with the applicable codes. If at the hearing it is determined that the repair, alteration, or improvement of the said dwelling, building, or structure in order to bring it into full compliance with applicable codes cannot be made at a reasonable cost in relation to the present value of the dwelling, building, or structure, the owner will be required, within a certain amount of time, to demolish and remove such dwelling, building, or structure and all debris from the property.
The owner and any parties in interest shall have the right to file an answer to this Complaint and to appear in person, or otherwise, and give testimony at the time and place stated above. “Owner” means the holder of the title in fee simple and every mortgagee and lienholder of record.
“Parties in interest” means persons in possession of said property and individuals, associations, and corporations who have an interest of record in the county where the Property is located, in a dwelling, building, or structure, including executors, administrators, guardians, and trustees.
The rules of evidence prevailing in courts of law or equity shall not be controlling in hearings before the Code Enforcement Administrator.
This Complaint constitutes a Lis Pendens Notice when recorded in the Lis Pendens Docket in the Office of the Clerk of the Superior Court of Decatur County, Georgia, pursuant to O.C.G.A. § 41-2-12(c). As a result of the action that has been initiated by this Complaint, a lien may arise against the Property described on Exhibit “A.” An itemized statement of liens is maintained on the Lien Docket maintained by the City Clerk of Bainbridge, Georgia.

EXHIBIT “A”
All that tract of land in Bainbridge, Decatur County, Georgia, in Land Lot 331 in the 15th Land District described as follows. Commence at the northeast corner of the 4 acre tract described in a deed from S. Brinson to Oscar Davis recorded in Book T-2, Page 498, Land Records of Decatur County, and from said northeast corner run west 62 and 2/5 yards, thence south 62 and 2/5 yards, thence east 62 and 2/5 yards, thence north along the east boundary of the 4 acre tract 62 and 2/5 yards to the point of beginning.
