PUBLIC NOTICE

NOTICE OF SALE UNDER POWER

WHEREAS, The Broad Street Ivy, LLC (“Borrower”) did execute to Faith Real Estate Investing, LLC (“Lender”), a certain Deed to Secure Debt (as described below) to the following lands located in Decatur County, Georgia, to-wit:
All of that certain tract or parcel of land situate, lying and being in the City of Bainbridge, Decatur County, Georgia, and more particularly described as follows:
Commence at a point on the West right of way line of South Broad Street at its point of intersection with the South property line of property now or formerly owned by Myra L. Johnson, and from said point of beginning run thence South along the West right of way line of South Broad Street a distance of 71 feet to property now or formerly owned by J. P. Waddell; thence run West along the North property line of property now or formerly owned by J. P. Waddell a distance of 115 feet, more or less, to property now or formerly owned by J. P. Waddell; thence run North along the East Property line of property now or formerly owned by J. P. Waddell and parallel to the West right of way line of South Broad Street a distance of 71 feet to property now or formerly owned by Ann C. Gragg Carr; thence run East along the South property line of property now or formerly owned by Ann C. Gragg Carr and property now or formerly owned by Myra L. Johnson a distance of 115 feet, more or less, to the West right of way line of South Broad Street and the point of beginning. This is a portion of the same property described in a Warranty Deed from P. H. Battle to Mrs. Edna Huff Battle, dated May 22, 1940, and recorded May 28, 1940, in Deed Book Y-4, Page 264, of the Land Records of Decatur County, Georgia.
The physical address of the property conveyed hereby is: 316 S. Broad Street, Bainbridge, GA 39819

To secure the following indebtedness: (1) that certain promissory rate note executed by Borrower in favor of Lender dated July 14, 2025, in the principal sum of $390,000.00; (2) all renewals and extensions of the aforesaid promissory note; and (3) all additional loans and advances that might subsequently be made to Borrower by Lender, and all other indebtedness of Borrower to Lender, all as is more particularly shown by the following described Deed to Secure Debt:
That certain Deed to Secure Debt executed by Borrower in favor of Faith Real Estate dated July 27, 2025 and recorded July 21, 2025 in Deed Book 550, Pages 0004 - 0008 in the Office of the Clerk of the Superior Court of Decatur County, Georgia (the “Deed to Secure Debt’).
(The above-described deed to secure debt is hereinafter referred to as the “Deed to Secure Debt’).
WHEREAS, the Deed to Secure Debt and the indebtednesses secured thereby are owned and held by Lender.
WHEREAS, Borrower defaulted by failing to pay the indebtedness secured by the Deed to Secure Debt and in accordance with the provisions of aforesaid promissory note and the Deed to Secure Debt, Lender has exercised its option to declare the remainder of said indebtednesses immediately due and collectible.
NOW, THEREFORE, according to the terms of the Deed to Secure Debt and the law in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the lands described in the Deed to Secure Debt, after proper advertisement, on the first Tuesday in June, 2026 (June 2, 2026) between the legal hours of sale before the Courthouse door in BAINBRIDGE, DECATUR COUNTY, GEORGIA.
The proceeds from said sale will be used first for the payment of the total indebtedness now owed Lender, including principal, interest, attorney’s fees and expenses, and the balance, if any, will be delivered to the persons legally entitled thereto.
Pursuant to O.C.G.A. Section 44-14-162.2 the name of the person or entity who has the full authority to negotiate, amend, or modify the terms of the aforementioned indebtedness is:

Please take notice that the Lender is not required to negotiate, amend, or modify the terms of the aforesaid promissory note and the Deed to Secure Debt.
Notice of the initiation of proceedings to exercise the power of sale contained in the Deed to Secure Debt has been provided to Borrower in accordance with O.C.G.A. Section 44-14-162.2.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property are: BORROWER or a tenant or tenants claiming under thereunder. The property is located at 316 S. Broad Street, Bainbridge, Decatur County, Georgia
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of said Deed to Secure Debt.
