NOTICE OF SALE UNDER POWER
COUNTY OF DECATUR
STATE OF GEORGIA
Under and by virtue of the power of sale contained in a Security Deed given by GORDON W. CANNON to FIRST PORT CITY BANK, dated May 6, 2021, filed for record June 2, 2021 in Deed Book 478 Pages 787-794, in the Office of the Clerk of the Superior Court of Decatur County, Georgia, conveying the after-described property to secure, among other debts, a Promissory Note in the original amount of TWENTY SIX THOUSAND FORTY ONE DOLLARS AND 34/100 DOLLARS ($26,
041.34), with interest thereon as set forth therein, there will be sold at public outcry for cash to the highest bidder before the courthouse door of Decatur County, Georgia, between the legal hours of sale on the first Tuesday in August, 2026, by First Port City Bank, as attorney in fact for Gordon W. Cannon, the following described property, to-wit:
All that certain tract or parcel of land situate, lying and being in Lot of Land Number 46 in the 21st Land District of Decatur County, Georgia, and being more particularly described as follows: Commence at the intersection of the center line of Barber Road with the center line of Barwick Road and running thence South 07 degrees 24 minutes 33 seconds East a distance of
472.30 feet to a point on the West right-of-way line of Barwick Road marked by an iron pin set which is the point of beginning. From said point of beginning, running thence South 04 degrees 27 minutes 56 seconds East along the West right-of-way line of Barwick Road a distance of
318.28 feet to a point marked by an iron pin set, running thence North 89 degrees 56 minutes 17 seconds West a distance of
158.29 feet to a point marked by an iron pin set, running thence North 03 degrees 58 minutes 03 seconds East a distance of
317.87 feet to a point marked by an iron pin set, running thence South 89 degrees 56 minutes 17 seconds East a distance of
109.67 feet to a point on the West right-of-way line of Barwick Road marked by an iron pin set which is the point of beginning. Said tract of land being more particularly described by reference to a plat of the same dated October 23, 1995, prepared by Larry W. Grogan, GRLS No. 1649, and recorded on Plat Slide B 130-5, Clerk’s Office, Decatur County Superior Court.
To the best of the undersigned’s knowledge and belief, the party in possession is Gordon W. Cannon, the grantor of said Deed to Secure Debt or a tenant or tenants claiming, by through or under said grantor and the street address of the said property is 526 Barwick Road, Brinson, Georgia, 39825.
The debt secured by the aforesaid Security Deed from Gordon W. Cannon is in default as to the payment of principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed, and that debt has been and is declared due and payable in full. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Security Deed and by law, including attorney’s fees. Notice of the initiation of proceeds to exercise the power of sale contained in said Deed to Secure Debt, along with the intention to enforce the provisions of the note for collection of attorney’s fees, has been provided in accordance with legal requirements.
The proceeds from said sale shall be used, first for the payment of the total indebtedness now owed Lender, including principal, interest, attorney’s fees, and expenses, and the balance, if any, shall be delivered as provided by law.
Said property will be sold subject to any and all outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, the right of redemption of any taxing authority, rights of persons in possession, if any, matters which would be disclosed by an accurate survey or by an inspection of the property and matters of record superior to the Security Deed first described above.
Pursuant to O.C.G.A. §
44-14-162.2 the name, address, and telephone number of the person or entity who has the full authority to negotiate, amend, or modify the terms of the aforementioned indebtedness and security deed is: First Port City Bank, 400 W. Shotwell Street, Bainbridge, Georgia 39817, 229-246-6200.
Please note that the secured lender is not required to negotiate, amend, or modify the terms of the secured debt.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the deed to secure debt.
