NOTICE OF SALE

STATE OF GEORGIA
COUNTY OF SEMINOLE

By virtue of the power of sale conferred upon the undersigned FAMILY BANK, grantee in that certain security deed, dated July 9, 2007, recorded in Deed Book 251, page 577, in the Office of the Clerk of Superior Court of Decatur county, Georgia, and that certain security deed dated December 19, 2007, recorded in Deed Book 259, page 585, in the Office of the Clerk of Superior Court of Decatur County, Georgia, wherein DAVID W. HILL and TAMMY L. HILL, are the grantors, such power of sale having become operative in consequence of grantors’ failure to pay the therein mentioned indebtedness in accordance with the terms agreed upon, the undersigned has elected to declare the entire amount due and payable and will, at the Courthouse door in Decatur County, Georgia on the 1st Tuesday in September, 2026, sell at public outcry to the highest bidder for cash, between the legal hours of sale the property described in said aforesaid security deed, described as follows:

Tract 1:
201 College St., Bainbridge, GA

All that tract or parcel of land lying, situate and being in Land Lot No. 280 in the 20th Land District of Decatur County, Georgia, and in the City of Bainbridge, and being more particularly described as follows: to find the point of beginning commence at the point of intersection of the centerline of Potter Street with the north right of way line of East college Street and run thence north 89 degrees 03 minutes west along the north right of way line of said East College Street a distance of 317.0 feet to an iron pin and the point of beginning. From said point of beginning, continue thence north 89 degrees 03 minutes west along the north right of way line of said East college Street a distance of 67.0 feet to an iron pin; thence run north 00 degrees 45 minutes east a distance 178.0 feet to an iron pin; thence run north 89 degrees 14 minutes east a distance of 67.03 feet to an iron pin; thence run south 00 degrees 45 minutes west a distance of 180.0 feet to an iron pin located on the north right of way line of said East College Street and the point of beginning. All in accordance with a plat prepared by Leroy Ouzts, GRLS No. 1654, dated September 12, 1995, and recorded in Plat Cabinet B, Slide 127-8, in the Office of the Clerk of Superior Court of Decatur County, Georgia.

Being the same property described in that certain deed from George B. Tomlinson to Josie Lewis, dated January 26, 1946, recorded in Deed Book K-5, page 519, Office of Clerk of Superior Court of Decatur County, Georgia.

Tract 2:
817 West St., Bainbridge, Ga

All that tract of land in Bainbridge, Decatur County, Georgia, described as follows: To reach the point of beginning commence at the intersection of the north right of way of College Street with the east right of way of West Street and run thence in a northerly direction along the east right of way of West Street a distance of 180.42 feet to the point of beginning. From said point of beginning run north 01 degree 39 minutes 12 seconds east along the east right of way of West Street a distance of 85 feet, run thence south 87 degrees 14 minutes 58 seconds east a distance of 327 feet; run thence south 01 degree 39 minutes 12 seconds west a distance of 85 feet; run thence north 87 degrees 14 minutes 58 seconds west a distance of 327 feet to the point of beginning on the east right of way of West Street. Said property contains 0.64 acre and is shown on a plat of survey prepared by Shad L. Atkinson, dated June 15, 1990.

Being the same property described in that certain deed from Winston T. Leslie, as Executor of the Estate of Clara Wimberly, to Catherine A. Pando, dated July 20, 1990, and recorded in Deed Book G-16, page 405, in the Office of the Clerk of Superior Court of Decatur County, Georgia.

Upon completion of sale, the undersigned will execute conveyance to the purchaser by virtue of the power of attorney in said deed, the proceeds from said sale to be used first to pay the indebtedness owing grantee by said grantors, attorney fees in accordance with notice given, the expense of the sale and the balance, if any, to said grantors.
