NOTICE OF SALE
STATE OF GEORGIA
COUNTY OF DECATUR
By virtue of the power of sale conferred upon the undersigned FAMILY BANK, grantee in that certain security deed, dated October 15, 2015, recorded in Deed Book 388, page 746, in the Office of the Clerk of Superior Court of Decatur County, Georgia, wherein CONSTRUCTION D & E, INC., is the grantor, such power of sale having become operative in consequence of grantor’s failure to pay the therein mentioned indebtedness in accordance with the terms agreed upon, the undersigned has elected to declare the entire amount due and payable and will, at the Courthouse door in Decatur County, Georgia on the 1st Tuesday in September, 2026, sell at public outcry to the highest bidder for cash, between the legal hours of sale the property described in said aforesaid security deed, described as follows:
All of Lot No. 13 of the Woodruff Estates Addition Subdivision in the City of Bainbridge, Decatur County, Georgia, and more particularly described as follows:
To reach to the point of beginning, commence on the south side of College Street a distance of 102.6 feet west of the southwest intersection of College Street with Gordon Avenue as measured along the south side of College Street and from said point of beginning, run thence south 00 degrees 57 minutes east a distance of 200.0 feet to the north side of a 15 foot alley, thence run south 88 degrees 30 minutes west along the north side of said 15 foot alley a distance of 100 feet to a point; thence run north 00 degrees 57 minutes west a distance of 200.0 feet to the south side of College Street; thence run north 88 degrees 30 minutes east a distance of 100.0 feet along the south side of college Street to the point of beginning, said property is described in accordance with a survey and plat thereof prepared by shad L. Atkinson, GRLS No. 2254, dated December 23, 1987, recorded in Plat Cabinet D, Slide 108, land records of Decatur County and further described in accordance with survey and plat prepared by Leroy Ouzts, GRLS No. 1654, dated April 15, 1991, recorded in Plat Cabinet B, slide 81-6, Decatur County, Georgia records.
SUBJECT to all easements and rights of way upon, across or through the above described lands as heretofore have been granted by the United States of America or its predecessors in title.
Said property is known as 1510 College St., Bainbridge, Ga.
Upon completion of sale, the undersigned will execute conveyance to the purchaser by virtue of the power of attorney in said deed, the proceeds from said sale to be used first to pay the indebtedness owing grantee by said grantor, attorney fees in accordance with notice given, the expense of the sale and the balance, if any, to said grantor.
